A Plymouth man sexually assaulted his girlfriend for nearly two hours while their infant son slept in a nearby bassinet, ignoring her repeated pleas to stop, according to a criminal complaint filed in Anoka County.
Andrew Jonathan Day, 22, faces charges of first-degree criminal sexual conduct involving penetration with injury and coercion and third-degree criminal sexual conduct involving penetration with coercion.

According to the complaint, Anoka police received a delayed report of criminal sexual conduct on Dec. 9, 2025. Detectives with the Anoka County Sheriff's Office interviewed the victim, an adult woman who had been in a relationship with Day since 2023.
The victim told investigators Day had pressured her into sexual acts throughout their relationship. She said he was never physically violent but used his size and persistence to overcome her refusals. Early in the relationship, he pressured her into oral sex. He apologized when confronted, but the behavior continued.
The couple separated in August 2024 but reconciled after the victim learned she was pregnant. Day moved into her family's home in January 2025. She ended the relationship again after Day was arrested for DWI in October 2025, but they later got back together.
Regarding the Aug. 10, 2025 assault, the victim said Day had returned from Army training that day. She found his phone near the Anoka County Fairgrounds and found him drinking in a parking lot. She took his keys to prevent him from driving and went home, the court documents say.

Day arrived about an hour later and was intoxicated. The victim was in bed with their infant in a bassinet nearby when Day began touching her inapproptiately. She repeatedly moved his hand away and told him she did not want to have sex because he was not sober. He accused her of being disrespectful and continued.
The victim attempted to go to sleep, but Day began undressing her despite her saying no. She told investigators she felt trapped because their infant was in the room and she didn't want Day to get angry and take it out on their son.
Day began penetrating the victim and when she asked when it would end, he told her she would "take it for as long as I want you to." He eventually stopped, then resumed and became more aggressive, spanking and spitting on her and calling her derogatory names.
The assault lasted nearly two hours, spanning into the early morning of Aug. 11. The victim said she showered afterward and Day followed her into the shower and continued touching her while she again told him to stop.
Day is charged with first-degree criminal sexual conduct, which carries a maximum penalty of 30 years in prison and a $40,000 fine. He is currently in custody, with a next court appearance set for April 6.
